Purchase Agreement Terms and Conditions



Thank you for your order. The following terms and conditions apply to your purchase. Items ordered online must be picked up at our nursery location unless the delivery option is approved by Client at time of sale. Please allow 5-10 business days to procure your order. Classic will contact the Client once the order is ready for pick up. All orders picked up at nursery location are subject to tax on date of purchase, currently 8.6%. 

If delivery is approved at the time of purchase online by Client, Classic will make a reasonable and workmanlike effort to deliver materials as described. The delivery date and time may vary from that noted above. After delivery to Client site, Client agrees to indemnify and hold Classic harmless  against any liability related to theft, damage or loss caused by others not under Classic supervision. In some instances, plant materials may vary in foliage texture, size and color from those pictured on the website. Because of the diversity in some species, some plants are listed in multiple categories and individual plant selection categories may not be accurate. Unless a full quantity order only is specifically requested in writing as part of this order, Classic will fulfill as much of the order as is locally available and in healthy purchase condition as determined by Classic. In some instances, select items will not be available. Should this be the case, Classic will contact the Client by email and at the Clients written request, then issue a refund to the Client in a prompt and timely manner, including a recalculation of delivery, handling and/or installation fees as appropriate and as determined by Classic. If desired by Client, Classic will continue to try to locate this item to be procured and delivered, unless Client cancels the remainder of the outstanding unfulfilled order prior to Classic procurement of the item(s). 

Client returned or refused healthy plant materials delivered to the project site or special ordered on behalf of the client are subject to a separate restocking fee equal to 50% of the plants retail value prior to refund. This amount will be invoiced upon restocking of plant materials. No additional discounts apply to this purchase. All new plantings using Classic supplied materials will be guaranteed for 90 days from the date of delivery as noted herein. All new plantings using Classic supplied and installed materials will be guaranteed for one year from the date of delivery as noted herein. This warranty is based upon reasonable care by Client and as determined solely at Classic's discretion. Except as set forth below and upon timely payment in full of all invoices, Classic warrants that the workmanship and materials supplied by Classic shall be of good quality and within the description and criteria set forth within the approved proposal(s) and this Agreement. This warranty is given in lieu of all other warranties, express or implied. Plant and construction materials supplied by others, annuals and transplanted materials are not guaranteed. Warranty shall be voided in the event that any payment is not received within 30 days of the invoice date. Warranted plants larger than 5 gallon size shall be replaced by Classic personnel on site; all others shall be picked up by Client at the Nursery and planted by Client. Classic may elect not to replace plant material based upon its sole determination that said plantings have died as a result of unusual weather conditions, Client neglect or damage beyond Classic’s control. Plants rated as not hardy in the planted site climate zone will not be guaranteed against heat or cold damage. Plant materials purchased from Classic and installed by Client are guaranteed for a period of 90 days from the date of purchase unless otherwise specified by Classic in writing. Client is not required to bring expired plant material to the Nursery unless directed to do so by Classic staff. Clients that do not have automatic irrigation systems in place at time and landscape bed location(s) of planting  will be required to remit 50% of the claimed plant retail value as determined by Classic  prior to procurement of any replacement plants. Client shall notify Classic of a warranty claim in writing by letter, fax or email, identifying the warranted material that needs replacing. If approved, Classic shall then prepare a work order authorizing Client to pick up replacement plants at the Nursery or will arrange replacement as noted above. Client agrees to pickup any outstanding warranty claim plant materials or to utilize the warranty credit within 90 days of written approval of the warranty claim or such claim will be deemed invalid. In some instances prior to or at the time of initial installation, substitute type, size and/or quantity of plant or hardscape materials may be supplied due to unavailability or poor quality of regionally available materials. At Client’s request, plants that are not available or have quality issues will be backordered under a separate work order and installed when available. In this instance, Client may elect to receive a credit on the final invoice for plants and installation labor. If Client elects to wait for the installation of backordered plant materials, all unpaid invoices must be paid in full. Healthy plant materials refused by Client after special order to the nursery or delivery to Client site may be subject to a restocking charge equal to 25% of the retail price. In the event that Classic’s Nursery is seasonally or otherwise closed, plant materials will be made available to the Client at Classic’s discretion upon re-opening. If a Client claim is requested after May 1 and before September 1, plant materials will be made available to the Client at Classic’s discretion after September to ensure better plant viability.
